TenzaONE Terms & Conditions

This Terms of Use Agreement (“Agreement”) is entered into between [Tenza Climate, TenzaOne, Net0Link, Climatenza] GmbH (“Company,” “we,” “us,” or “our”), registered respectively in Germany, Germany, India and India and the user (“User,” “you,” or “your”).

Platform Services

The Company provides a platform (“Platform”) facilitating cross-border project funding between investors and project developers, with particular focus on projects in India[1]. The Platform operates as an intermediary, with collections handled through our Indian subsidiary.

Service Structure
  • Project funding facilitation services
  • Collection services through Indian subsidiary
  • 10% intermediary fee charged to borrowers on finance fees
  • Direct project funding or intermediary-based structures

Collection and Payment Framework

Indian Operations
  • Collections managed by Indian subsidiary
  • No separate collection charges applied
  • Operating under Indian foreign exchange regulations[12]
  • Compliance with RBI requirements for cross-border transactions[44]

Investment Parameters

Project Structure
  • Direct funding to project developers
  • Intermediary services for licensed finance houses
  • EU and US-based financial institutions as primary funders
  • Project-specific investment documentation

The Company does not provide advice nor does it make recommendations.

Risk Disclosure

Users acknowledge:

  • Investment risks in project funding
  • Cross-border transaction risks
  • Currency exchange risks
  • Project execution risks

Data Protection

User data processing complies with:

  • EU General Data Protection Regulation
  • German Federal Data Protection Act
  • Indian data protection requirements[22]

Governing Law

This Agreement is governed by German law, with exclusive jurisdiction in German courts[19].

Amendments

The Company reserves the right to modify these terms. Users will be notified of significant changes.

By using the Platform, you acknowledge reading and agreeing to these terms, understanding the investment nature, and accepting associated risks.
